1. Definitions

"Designer" refers to Something Fishy Designs, its employees, and subcontractors.

"Client" refers to the individual or organization commissioning the design services.

"Project" refers to the specific design work agreed upon by the Designer and Client.

2. Services Offered

  • Logo and branding designs
  • Posters, pamphlets, and business cards
  • Email signatures and CV/resume templates
  • Website design, maintenance, and banners
  • Custom software and web application development
  • Custom quotes and invoice templates
  • Social media graphics and setup
  • Certificate designs and templates

3. Payment Terms

Website Development: A 50% non-refundable deposit is required before work begins. The remaining 50% is due upon project completion, prior to delivery.

Design Services: Full payment is required upfront for all design services before the project starts, unless otherwise specified in writing.

Custom Software: Payment terms are agreed upon individually based on project scope and milestones.

All website hosting required is to be paid by the client, unless agreed upon otherwise.

All prices will be tailored to your requirements.

4. Project Timelines

Standard Designs: Turnaround time ranges from 5 to 10 business days.

Website Projects: Timeline varies from 10 to 20 business days depending on scope and complexity.

Custom Software Projects: Timelines are agreed upon individually during project scoping.

Timelines are subject to change depending on client response times and specific project requirements. May vary during peak seasons.

5. Client Responsibilities

Clients must provide clear instructions, feedback, and all necessary materials or information on time to ensure efficient project progress.

To ensure best results, please provide all necessary information and feedback promptly.

6. Amendments and Revisions

We offer a reasonable number of revisions to ensure satisfaction.

Substantial design changes or extra revisions outside the original agreement may be subject to additional fees.

7. Ownership and Intellectual Property

Ownership of the final design or website is transferred to the client upon full payment. Until then, all designs remain the intellectual property of Something Fishy Designs.

We may use completed designs for our portfolio and promotions unless otherwise agreed upon in writing.

8. Confidentiality

We respect client confidentiality. Any sensitive information shared with us remains protected. Information will only be disclosed to third parties with client consent or if required by law.

9. Refunds and Cancellations

All payments are non-refundable. Cancelled projects will be billed for work completed up to the cancellation date.

In exceptional cases where we cannot fulfill the project, a partial refund may be considered at our discretion.

10. Limitation of Liability

We are not liable for any indirect, incidental, or consequential damages from the use of our services. This includes issues from third-party hosting, software, or services used with our work.

11. Governing Law

These terms are governed by the laws of South Africa and are subject to South African jurisdiction.

12. Updates to Terms and Conditions

We reserve the right to update these terms at any time. The latest version will be posted on our website. Continued use of our services implies acceptance.
